Terms of Service

These Terms of Service ("Terms") govern your access to and use of Notify Beforehand ("the Service"), operated by Eversoft Fzco("we," "us," or "our"), a company registered in the United Arab Emirates.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

Notify Beforehand is a cloud-based SaaS platform that enables businesses to:

• Track employee certifications, licenses, and permits with expiry dates
• Receive automated email reminders before certifications expire
• Store and organize certification documents securely
• Generate compliance reports for audits and inspections
• Manage team members and their certification status through a centralized dashboard

To use the Service, you must:

• Be at least 18 years old
• Provide accurate, complete, and current registration information
• Maintain the security of your account credentials
• Accept responsibility for all activity under your account

You must notify us immediately if you become aware of any unauthorized use of your account at support@notifybeforehand.com.

4. Payment Processing & Merchant of Record

We offer the following subscription plans:

• Pro Plan: $49/month (or $24/month billed annually) — for teams up to 50 members
• Business Plan: $99/month (or $49/month billed annually) — for unlimited team members with advanced features

Prices are in US Dollars and may be subject to applicable taxes as determined by Paddle.com based on your location.

We reserve the right to change pricing with at least 30 days' notice. Price changes will not affect active subscription periods.

Each plan includes a complimentary 3-day free trial with full access to all features. The trial is designed to give you sufficient time to evaluate the platform before your subscription begins. At the end of the trial period:

• You will be prompted to subscribe to continue using the Service
• If you do not subscribe, your access to premium features will be paused
• Your data will be retained for 30 days

You may cancel your subscription at any time from your account settings. Cancellation is simple and hassle-free. Upon cancellation:

• You will retain access to the Service until the end of your current billing period
• No partial or prorated refunds are issued for unused portions of an active billing period
• All subscription payments are final once the trial period has ended and the paid subscription has commenced

You retain all ownership rights to the data you enter into the Service, including employee information, certification records, and uploaded documents ("Your Content").

By using the Service, you grant us a limited license to process, store, and transmit Your Content solely for the purpose of providing and improving the Service.

You are responsible for the accuracy and legality of Your Content. You represent that you have the necessary rights and consents to upload any employee data or documents.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the Service or its systems
• Upload malicious code, viruses, or harmful content
• Interfere with or disrupt the Service or its infrastructure
• Resell, redistribute, or sublicense the Service without our written consent
• Scrape, crawl, or use automated tools to extract data from the Service

We strive to maintain 99.9% uptime but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to:

• Scheduled maintenance (with advance notice)
• Emergency security updates
• Circumstances beyond our reasonable control (force majeure)

The Service, including its design, code, features, branding, and documentation, is owned by Eversoft Fzco and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

To the maximum extent permitted by law, Eversoft Fzco shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

The Service is provided "as is" and "as available." We make no warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will meet your specific compliance requirements. You are responsible for ensuring that your use of the Service satisfies any regulatory obligations applicable to your business.

You agree to indemnify and hold harmless Eversoft Fzco, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

We may suspend or terminate your access to the Service if:

• You violate these Terms
• Your payment is overdue for more than 14 days
• Required by law or to protect the rights and safety of others

Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days, after which it will be permanently deleted.

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the United Arab Emirates.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and, where appropriate, sending you an email notification. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
